I have a friend who is up for murder at this very moment. Family business had been robbed repeatedly and he was fed up. Caught them at the fence line but did not fire untill they were on the public roadway.
Split second decision in the heat of the moment and there you have it.

This is why I am so thankful that nothing happened over some freaking tools. It is a situation you have to keep a cool head in and I know this but unfortunately I was not in the right frame of mind and who knows... I do know I would have been more fezzed up if it were at my home so I need to re-evaluate the thought process to stay calm

Question: Was it in Texas??? Was it in the republic of Austin?? If it was in the republic of Austin would not surprise me with Ronnie Earl the prosecutor. Anywhere else in Texas and I would be amazed.

It was in the Valley.
Prosecuter says he did not have reason enough to fire. They had not made it into the fence yet and could have been taking a leak or changing a tire. Although when he pulled up they all ran back into the car and hauled azz. He shot as they were fleeing.
The two survivors first said they had just stopped to relieve themselves and no stolen goods were found in the car.
Hidalgo county sherriffs found the fence cut the next day and they admitted they were planning on breaking in.

i have lived here in the bluff all my life and in some ways it has gotten so bad compared to when i was growin up. the latest problem happened only a few months ago. i live in the wharf appartments with my wife and my one year old boy. (if you're looking for an apartment...dont come to this sh** hole) anyway, we were hurtin pretty bad for some cash, so i sold my truck (my baby) for an amazing 2 grand. spent 100 bucks that night for gas and some food. that leaves me with 1900. told my wife to deposit the money the next day....i go to work, she had to run for some family emergency and didnt get the chance to make the deposit. i call her around noon to see how she was, she tells me shes out and the maintenance man is doing AC repairs. got a rotten feeling, so i head home and sure enough, the mo**** son of a ***** took the cash from under my coffe can upstairs. Evil or Very Mad i was so freakin steamed. called the police, filed a report, got ONE phone call a while back and thats it. ok..everyone listen carefully,,,,you ready?..............

That's pretty brutal. Best of luck with that bluff rat.

I have a question about the bluff though. Earlier in this thread reference was made to the bluff's schools which I understand are independent of the cc school system. If the bluff is this rough, how can the bluff school system stay solid?

Back in my hometown of a whopping 5000 residents, when local businesses started hurting, the town started seeing a lot of crime and drugs. There is an undeniable link b/t strength of the local economy, employment rates, consequent tax base, and. . . the school system. My hometown today is now a shell of its former self, including a dysfunctional school system. One I'd never send my kids to.

personally, i believe fbisd is a very good, solid school. and flour bluff as a town is a very good one, but when you have lived here for so long and lived in every corner, sooner or later, you run in to the not so nice parts of the bluff. generally, north of spid around NAS is not a great area along with the stone st. , dewitt st, weaver st, etc. along SPID between waldron and flour bluff drive. other than that, flour bluff is full of great neighborhoods and poeple. i grew up in the places i mentioned and its such a shame to see what it has turned in to.

It is now an allowed under Texas law to shoot to kill in defense of property. The prosecutor may well have a rough time with this. Does not help your friend I realize, but this is a perfect example of why we need to elect prosecutors who will follow the law and not try to create or twist it to meet their on personal philosophies.

It's a shame this dirtbag prosecutor is trying to turn your friend into the criminal here. BUT...I would expect any D.A. to send something like this to a Grand Jury. Is he actually awaiting trial? Hopefully a jury of his peers would acquit him. I would think that if he actually caught them in the act or at least were still on his property fleeing, then it would be a different story. Hoping the best for your friend and his family.

I believe that under the castle law, you still have to be in fear for the life of yourself and your family. It's sad to say, but the prosecuter will have an easier time than some think because the bad guys were not threatening anyone yet. Hopefully, he'll have an understanding jury.
