| you would think these head boats would have a little more sense than to practice how they do. They sure whined a lot about their livelihood's being wrecked when snapper limits were reduced, but apparently, they aren't very concerned about their livelihood when they stay parked over a rock for 3 hours pulling in 70/30 split between undersize and keeper snapper not practicing better release techniques. |

There is a small town called Port A
Where head boats fish day after day
But their crews all sure suck
No matter their luck

Fished snapper on the Port A day-tripper
The shorts came and went
Not one did he vent

This post had the best of my curiosity so I emailed TPWD...here is the response I received.
"To whom it may concern;
Thank you for your inquiry on the legality regarding the unsuccessful release of oversized fish. A fisherman should make an attempt at reviving a fish when it appears stressed due to capture. If the fisherman has attempted to release the fish in a manner to best ensure its survival but the fish dies then the fisherman is not obligated to retrieve a fish that is not within the lawful size limit to possess. A violation could be determined by whether or not the individual intended the fish to die or if they expended effort in reviving the fish. If the fish is of lawful size, then an individual would be required to retain the fish to be in compliance with the law. Please feel free to contact me if you have any further questions. Thank you.
Texas Parks and Wildlife Code Sec. 66.011. LEAVING FISH TO DIE. A person commits an offense if the person leaves edible fish or bait fish taken from the public waters of this state to die without the intent to retain the fish for consumption or bait."
