friggen ridiculous! This thing needs to get repealed down, unless people want an out right ban on boats in the laguna madre.

once again, loss of rights for the "protection of the environment".

looks like the wade paddle pole enviro nazis got their bill passed.

I guess I will have stay in Nueces forever after reading this. I do not think I can even run my whaler across the flats near Pita on a low tide without getting to close for comfort. No more anchoring anywhere there is sea grass, very interesting. Shocked

the article mentioned 216 acres of protected area, but that must be a mis print, with the language of the bill stating "within the jurisdiction of the state of texas"

no trolling motor use that would uproot seagrass

no anchor use (power pole is an anchor, and I didn't see any designation on "what" an anchor is)

no outboard use in a manner to stay on plane.

The idea for this bill came from TPWD's Coastal Users Work Group (CUWG). The 2 excerpts below are from the CUWG final report :

re: http://www.tpwd.state.tx.us/publications/nonpwdpubs/media/coastal_user_working_group_report.pdf

"The working group was made up of nineteen members and was chaired by Robin Riechers, Director of the TPWD Coastal Fisheries Division. Members included representatives of the Coastal Conservation Association, the Saltwater Enhancement Association, the Coastal Bend Bays and Estuaries Program, the Coastal Resources Advisory Committee, the National Estuarine Research Reserve System, the Recreational Fishing Alliance, Texas Wade Paddle and Pole, Audubon Texas, Texas Wildlife Association, Texas Airboat Association, fishing guides from the upper and lower coast, a TPWD Law Enforcement official, and two anglers appointed as at‐large members. A member from the Padre Island Business Association was invited to participate, but declined due to a conflict in scheduling. The majority of the members were from, or primarily recreated in, the coastal bend area. There were a few members from outside this area."

"With nearly unanimous agreement, the working group concluded that the highest priority recommendation was for the state of Texas to develop a statewide seagrass protection regulation. While TPWD does not currently have authority to create such a regulation, the working group felt that the department should collaborate and communicate with outside organizations and the Texas Legislature to create such a regulation. "

WPP had our say during the legislative process - at the House Committee for Culture Recreation and Tourism public hearing on this bill. Our testimony is public record - as is the CCA Texas testimony of support given at the same hearing.

OFT II --

You need to read the bill with a little more care. The bill actually allows the the items you list above as "defense to prosecution" which more or less means they are excluded . That is - you can use a trolling motor ; you can use an anchor ; and you can get your boat up on plane under this law.

so let me ask... does "defense to prosecution" mean that these actions are clearly excluded, or that one could try to argue they were doing this when seagrass met an untimely death? Seems to me that a boater could be "prosecuted", and hopefully the "defense" of your case could be one of these... providing the judge agrees.

also, is WPP "satisfied", or are we going to see more from them to shut down areas to boating altogether?

Brine,

were you the guy that tried to stage a photo showing an airboat trying to run you down in lia back lake, but then after word got out, the truth came out about the kayaker (you?) actually paddling towards the airboat trying to cut him off actually in around the entrance to lydia ann channel, not a back lake like the WPP facebook page stated? Also, Whatever happened to that case being reported to the proper authorities like the WPP facebook page said? anyone get fined over that?

if that was you, sorry I don't take your word for what your interpretation in the language of the bill says..

if you're not chugger from 2cool, then my apologies.

Agreed - I would advise you to read and figure this bill out for yourself, or if you don't feel qualified, ask TPWD's Legal Division, or a private attorney, for an opinion.

since you declined to answer, I'm going to assume a "no" for my question about WPP being completely satisfied with the results of this bill, that would lead to further push from the group closing off more areas to boating.

Maybe this explanation will clear things up. I wrote this when the bill passed.
