well... xxxxxx...
5/28/2017 driving off pins, almost out of park, I pulled over right in front of the 65mph sign. Anyways, with the construction, kiddo fussy, the mrs and I wanting to get to the RV, was going a little faster than posted sign.... but below the speed limit sign... Rolling Eyes

Regardless, after field sobriety test, and repeat test(eye test 3 times), straight line(car passing that didn't move over when passing... fun at night), finally shoved a breathalyzer and claimed I failed.

Transported to CC finest over night accommodations. With all of this BS, I do appreciate Park rangers for parking my truck, and driving my wife, daughter and dog to the Port A ferry to catch a cab back to Aransas Pass where we had the RV. My wife does not know how to drive a stick. But other than that, hotter than hell on the entire situation.

PM me if better, but I live in Bandera and have a Court date set for Sept 20 in Corpus.

Any one have recommendations for attorney since this is in federal court. Or any one unfortunately have similar situation on PINS.

Any advice is much appreciated.

Don't recall there ever being a 65mph sign to or from PINS. Highest is 60, perhaps if you were doing over what you thought was a 65 then that's why.

I was in a similar situation except got pulled over for hitting the white stripe on the edge on the road. Got a few field sobriety tests and they let me go. No need for them to do a field sobriety test because I had only had 1 beer about 3 hours before I was pulled over, so completely within my legal limit. And like stated above there is no 65mph sign to or from PINS. There's a 55, 45, 60, 15, 25, 35,5, but no 65. And there is fair warning that the speed limit is strictly enforced, which is why I set my cruise control right at the speed limit and usually have a line of cars behind me. It sucks it happened to you, but really at this point it is what it is and precisely why I don't drink more than 1 or 2 beers if I'm traveling on the national seashore. (But if I'm staying overnight.... totally different story.... Twisted Evil ) The rangers at PINS are notorious for finding any little thing to give a citation. Chalk it up to an expensive lesson learned.

if it was really like you say, and that borderline, (no breathalizer?) take it up in court and let a jury watch the video.

reasonable doubt is the key here. I will save my words about drunk driving, but I sat on a jury where a woman was charged with it, and she did not appear drunk in the video. only very nervous.

Her attorney asked the arresting officer to stand on one leg and count to 10 like he made her do in the video, and the guy stumbled about half way through it. He was very nervous as well and obviously not drunk, but he stumbled... like a drunk person would. That was eye opening for me.

We have been pulled over once for crossing the "fog line" once. Husband was fascinated with the moon Rolling Eyes we had our son with us at the time and just got a warning and a reminder to turn our plate light on. That's what happens when we let the kid play in the truck, I think that night we also had a quarter shoved into the disk player...
Other then that we have never had an issue with park police.

Good luck brother...I was hassled down there a long time ago for a radar detector. It was overboard but hey they didn't shoot me so that's a good thing.

Thanks for the input. At least it wasn't one of the gong hoo rangers that pulls you out of your car at gun point. Ran into him a few years back. He did not know what to think when we had two beer cans full of water for the dog. That was when their was a power outage on the island and we were heading down to the jetties. Couldn't buy anything at stores so we sacrificed a couple of beers, all our water bottles were frozen, including a couple on the dash. He was more concerned with the brass and couple shells in the door compartments.
He even said I can give you a dwi for open and full beers. His expression when I poured water out. I should have told him we were the decoy drunk drivers.

Will update after Sept 20th.

Durn man, sorry to hear about your trouble. DWIs are bad mojo these days. But have courage, it's not the end of the world, you'll get through it.
