Damn Tarzan...

I didn't see your post until after I posted in answer to troutslayers.

That totally sucks, but it fits right in with the current management philosophy - "We own the park - not the people. Obey our every whim - or else."

That's the problem with giving too much power to law enforcement. Even though most Law Enforcement officers are honorable and just, it just takes a few of the type you encountered (would be gestapo) to screw over the citizens.

I'm not sure about Fish Chasers comments, but he may have just meant that your problem is severe enough to have it's own post and tread - including comments from the other board members who have had the same problem. Maybe there is something the group as a whole can do to help.

I wish you well and hope you find good legal advice.

Thanks for your response Seaweed and Frayed. I'm not too worried about beating the charges. They are obviously BS and the real kicker is the two speeding tickets. If a speeding violation is a safety issue(which it is)...Why would a law enforcement officer just sit and watch you speed all the way down a road with a 25mph limit and then watch you speed down a road with a 45mph speed limit before he attempts to pull you over Question( I have been driving for exactly 28 years and NEVER had a speeding ticket) Each speeding ticket was written exactly 11 miles over the limit as well...Wow what a coincidence. Bottom line is this park administration is a disgrace. I can't wait to see the "marijuana pipe" that he wrote me a ticket for...because there was not one.. I am missing a 6"X 3/4" aluminum extension piece for one of my window cleaning squeeges...could that be the pipe in question? Mabey I will demonstrate how it is used for the jury... Matlock style.Pathetic plain and simple. Amerika I am ashamed!!
later,
Ernie

Tarzan,

Sounds like you should PM Troutslayer for representation. He seems to be doing a bang up job on the park service already, he may be willing to take this on since he has apparently lost his chance to go after Joe for his own tickets since they got dis-missed.

Please keep us informed as to your situation since it seems like this is going to happen to another one of us shortly.

Sean

Tarzan

That is a total load of crap man. I'm sorry you had to deal with that because you refused a search. It seems we have no rights anymore. I refuse to visit PINS until this crap is taken care of. That ranger needs to be fired.

I haven't been back to PINS since the cleanup. That one ranger stopped me the weekend of the Breakaway fishoff. The following month was the cleanup and he spun around behind me like he was going to stop me again, but he saw the orange trash bags and turned around...Adios

Skipper

BTW, I too will not return.

I totally can't believe what I'm reading!
I was also stopped by this guy a few months ago as I've previously posted. I'm sure he would have jacked me up but he didn't because he saw my 5 year old son sitting in the back in his child seat. After that I saw that he had 2 cars pulled over during the beach clean up. Since then I've felt as though I've been walking on egg shells when I go fishing there. I was there friday evening wade fishing and when I left I had a cigar in my mouth as I was leaving. I was driving out of the gate by the booth and a ranger was coming in, I saw him eyeballing me as we passed each other(I guess he thought I might be smoking a blunt) and he turned around to follow me. I was watching him through my rear view and I guess I caught a break because he changed his mind and turned back to re-enter the park. I'll count my blessings now because even though I was completely innocent, I'm sure he would have found something to make my life difficult. I've made up my mind now. PINS is a beautiful resource that we HAD, but the coastline is vast and I have many honey holes where I won't be harrassed. I won't be going back and sorry Capt. Billy, no more beach clean up for me.

Well wait until you here what happened to me May 31st at 5:30 pm coming off north beach road. I need an attorney. Pulled over at the exit of PINS boundary by "Rouge Ranger matt"...he asked to search my vehicle..I said NO...he said get out of the vehicle...put your hands behind your back... you're under arrest. I said"for WHAT"...DUI..I said" I haven't had a drink "..
He then wrote me SEVEN violations including...DUI,REFUSAL TO SUBMIT, 2 SPEEDING VIOLATIONS, UNSAFE OPERATION, TRAFFIC CONTROL DEVISE, and POSSESSION OF PEREPHENILA(MARIJUANA PIPE) ....i DON'T OWN A PIPE!!!!!!!??, WTF ya'll. This guy has the same MO and I'm not making this up. He has pulled over at least four guys on these boards with this BS including Skipper, Pete Morales, Snake, and Boliver. He pulls you over with a BS excuse (Skipper-I could not see your front plate) WTF. Anyway, I was arrested, my truck towed, and now face 7 charges in federal court because I would not let this guy search my truck WITHOUT probable cause!!! You see, if the officer can make up something to arrest you for, he no longer needs probable cause. I could sure use some help from anybody who has had any unjustified treatment from the new PINS staff now.I will have a lawyer soon(I hope) and please help to stop this mistreatment. I was RAILROADED...If anybody really cares about the big brother BS going.. Please help. They want to put me in Jail for this and it is all not true. I was drinking Ozarka for Gods sake and he was pissed because I said no to an unresonable search of my vehicle...is this still the USA my family died for in wars for this country Exclamation

Do the park rangers have the same non consent search authority that state game wardens do?

I would assume that you are subject to search and authorizing it just by entering any federal park or other federal area.

I guess that it no longer matters whether or not a park ranger has the authority to perform a non-consented search on me or not. I'm not driving some 260 miles from Austin just to get harassed when I could have stayed home and gotten harassed there!

Seriously, my yearly pass has expired and I see no reason to renew it with all the problems they are having there at the PINS. The worst thing is that nobody wants to step up to the plate and fix what's wrong. I'm referring mainly to the rogue park ranger, too few parking spaces at the ramp, and exorbitant towing fees by a thief. Oh, let's not forget the price of gas starting to go back up for no apparent reason.

Damn, we're getting hit from all angles. I understand that a law enforcement officer has the right to request a search if he has "probable cause." It is at this point that things start to fall apart because if you are speeding 1 mile over the limit, he can state that he had "probable cause." What kind of crap is that? From what I've been reading, I'm fairly certain that the rogue park ranger wouldn't hesitate for one second to lie about somebody by saying that they were speeding just so that he can justify his illegal search. Man, when does this end?

Well, for his part at least, TroutSlayer HAS stepped up to the plate!!! Now he just needs others to have his back as has already been covered on here. Show up at the trial/hearings or whatever else takes place and show the powers that be that he's NOT the only one who cares enough about his rights being violated to do something about it!!! I live 735 miles away or you can bet that I WOULD be there!!!!

If this same thing had happened 40 years ago and was still happening out there with Bob Hall Pier and the other things, it would never have gotten to the sorry state that it is today. Talk is cheap, actions are the only things that matter! Wink

landlocked beachbum: I'm sorry if I gave you the impression that I meant the we weren't doing anything about it. I guess I should have been more clear. When I say nobody's doing anything about it, I mean the people whose job it is to see that the people's needs are served, such as the National Park director and other people whose jobs are to serve the public. I appreciate your comments nonetheless.

Just out of curiosity.... how many of you guys are continuing to go down PINS after hearing about this?

I'm thinking two things..

1. there is some agenda to make PINS an "off limits" beach, and save it for the turtles and coke dealers and this rouge ranger is something else other than a regular park ranger to discourage people from going.

2. He's just a C sucker that needs his supple bum kicked.
